Open Letter to US Chief Justices Sotomayor, Kagan, and Jackson - February 3, 2025

Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson -

It is now only two weeks since President Trump took power, and already your 6 colleagues' decision in Trump v. United States (2024, on Presidential Immunity) is looking even more foolish than on the day it was announced (July 1, 2024). In these 2 weeks the President has (allegedly) committed the following unlawful acts:

In just two weeks' time, the President of the United States has indeed turned "the Oval Office into ... the seat of criminal activity in this country" [allegedly], as predicted by Justice Ketanji Brown Jackson on April 25, 2024 (Oral arguments, Trump vs. the United States (2024), pages 62-63). Justice Roberts' breezy claims of "fear mongering on the basis of extreme hypotheticals" (Trump vs. United States (2024), page 40) are no match for the reality in which this country now finds ourselves. Justice Thomas would have Americans believe that Trump currently blocking government spending directives from Congress represents just the kind of "vigorous Executive that our Constitution envisions." (Justice Thomas concurrence, page 1) This morning that "vigorous Executive" and his unelected, unconfirmed "bro' friend" suddenly blocked USAID staff from entering their building, froze foreign aid, shut down the agency's websites, and stripped photos of its aid work off the building walls.

It must be very difficult for the three of you Justices to work with the other six Justices day after day, knowing how much damage the SCOTUS decision Trump v. United States (2024) has already caused to this country. Thank you for your forceful and well-reasoned dissents. Please keep them coming! Although you are in the court's minority, history must record that there were protests, and vigorous objections, and Justices who upheld the Constitution, and politicians who faithfully discharged the duties of their office. And some happy day - when the present darkness lifts, and spiritual light dawns again upon this land; then the light of America the Beautiful will shine again because of dedicated public servants like you.
